After an appeal is decided, a veteran can submit a Post Decision Motion. There are three types of Post Decision Motions handled by the Litigation Support Team:
- Motion to Vacate (MTV)
- Motion for Reconsideration
- Clear and Unmistakeable Error (CUE)
A veteran can file a motion to vacate if they believe there was a due process error in handling their appeal. For more information, please see Motions to Vacate.
Implementing the ability to handle Motions to Vacate is currently in progress and is scheduled for completion in April 2020.
